Official Rules

 

NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. TO ENTER THE SWEEPSTAKES WITHOUT MAKING A PURCHASE, SEE RULE 3 BELOW.

 

OPEN ONLY LEGAL U.S. RESIDENTS, 18 YEARS OF AGE (OR LEGAL AGE OF MAJORITY IN STATE OF RESIDENCE, IF LEGAL AGE OR MAJORITY IS OVER 18) OR OLDER WITH INTERNET ACCESS AND A VALID E-MAIL ADDRESS. (SEE RULE 7 FOR COMPLETE RESTRICTIONS ON ELIGIBILITY FOR THE SWEEPSTAKES). VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

 

BY PARTICIPATING IN THE SWEEPSTAKES, YOU ACCEPT AND AGREE TO THESE OFFICIAL RULES AND THE DECISIONS OF BARNICLE CUSTOM MOTORSPORTS LLC (“SPONSOR”) REGARDING THE SWEEPSTAKES WHICH ARE FINAL AND BINDING IN ALL RESPECTS AND ARE NOT SUBJECT TO APPEAL.

 

1. SWEEPSTAKES PERIOD:  02/13/2026 at 12:00 a.m. ET - 04/13/2026 at 11:59:59 p.m. ET.

 

2. TO ENTER:  During the Sweepstakes Period, purchase items at Sponsor’s website, https://barniclecustommotorsports.com/(“Website”). Each dollar spent on the purchase price of a given item (EXCLUDING taxes and shipping charges) will automatically result in receipt of 1 entry in the random drawing. For example, if you purchase Bottomland Camo Shorts on the Website for $49.99,  you will automatically receive 50 entries. (In calculating the number of entries received, Sponsor will round up the item purchase price to the next dollar.) Should Sponsor offer discounts or coupons on the purchase of items, the purchase price of an item net of such discounts/coupons will be used to determine the number of entries received. Alternatively, eligible persons may choose to purchase entries in designated quantities at the Website without also purchasing any accompanying product. Only the purchaser as indicated on provided payment method will receive entries:  entries are NOT transferable by the purchaser. (If item purchase is a gift for someone else, the purchaser – not the gift recipient – will receive the entries for the purchase. Purchased entries cannot function as a gift and are only valid for the purchaser of same.) If purchase is made via mobile device, the purchaser will be solely responsible for all wireless carrier charges and other fees.  Any dispute as to the identity of entrant will be resolved by Sponsor based on the business records of entity providing the applicable payment method (for example, the credit card issuer). Receipt of entry will be acknowledged by Sponsor but such acknowledgment is not otherwise binding upon Sponsor. If purchased item is returned for a refund prior to the random drawing to select the prize winner as per Rule 4 below, the corresponding number of entries will be rescinded; if purchased item is exchanged for another item at Website prior to the random drawing, the corresponding number of entries will be adjusted to reflect the purchase price of the item for which the originally purchased item was exchanged. (Purchased entries are FINAL SALE and NOT REFUNDABLE.)

 

Multiplier. From time to time during the Sweepstakes Period, Sponsor will increase the number of entries available via product purchase or entry purchase. Each such multiplier will only be effective during the specified period and may be valid only on the purchase of certain designated products and/or on certain designated entry quantities available for purchase. Before and after the specified period that a multiplier is in effect, each dollar spent on the purchase price of a given product will result in receipt of 1 entry in the random drawing; and, each purchased entry will result in receipt of 1 entry in the random drawing. Sponsor shall determine the number of times the multiplier is in effect, with only one deployment of the multiplier being guaranteed. 

 

3. NO PURCHASE NECESSARY/ENTRYWITHOUT PURCHASE: print your name, address, e-mail address and year of birth on a 3” x 5” card and mail in a business size (#10) envelope to Barnicle Custom Motorsports LLC Sweepstakes Alpha- Entry,  P.O. Box 129 1665 US Highway 98 Lorida, FL 33857-9800, to be postmarked by 04/01/2026 and received by 04/10/2026.  Each valid 3” x 5” card will result in receipt of five (5) entries. But, if a valid 3” x 5” card is postmarked during a period that a multiplier is in effect, the number of entries received will be increased accordingly as per Rule 2 above.  Each 3” x 5” card must be mailed separately from an address in the United States.  Mechanically reproduced/copied 3” x 5” cards will not be accepted.  Receipt of 3” x 5” card will not be acknowledged. 3” x 5” cards become the sole property of Sponsor and will not be returned. Proof of mailing 3” x 5” card does NOT constitute proof of receipt of same or proof of entry.  

 

4. RANDOM DRAWING:

 

On or about 04/14/2026, an independent third party will conduct a random drawing from among all eligible entries received to select the potential prize winner.  Sponsor will notify potential prize winner via e-mail after random drawing. BE SURE TO CHECK YOUR “SPAM” OR “JUNK” FOLDER FOR THE WINNER NOTIFICATION E-MAIL FROM SPONSOR. The winner notification e-mail will include an Affidavit of Eligibility, a Liability Release and (where lawful) a Publicity Release(“Affidavit/Release”), which must be completed, signed before a Notary Public and returned to Sponsor within 3 business days of the date indicated thereon. The potential prize winner will be disqualified and will forfeit the prize without compensation of any kind if:

 

(a)  Sponsor is unable to contact potential prize winner despite engaging in commercially reasonable efforts to do so;

(b) Potential prize winner fails to return the completed and signed Affidavit/Release within the prescribed period of 3 business days for any reason; or

(c) Potential prize winner returns the completed and signed Affidavit/Release but Sponsor determines that the potential prize winner is in violation of these Official Rules including without limitation that he/she/they is not eligible to participate in the Sweepstakes.

 

In the event of disqualification for any reason, an alternate potential prize winner will be selected from among all remaining eligible entries received. 

 

 

5. PRIZE:

 

Prize (1) – 2026 Can-Am Defender HD11 Limited Lonestar Edition (Black) side-by-side utility terrain vehicle, assembled and customized by Sponsor.**Manufacturer’s Suggested Retail Price: $40,000.00.

 

**Trademarks are used for purposes of prize identification only. No sponsorship, endorsement, authorization or affiliation of any kind is intended or implied by such use. 

Winner is solely responsible for any and all costs related to acceptance and use of the Prize. The preceding includes but is not limited to 

(a) any license or registration that may be required by winner’s jurisdiction of residence;

(b) any upgrades, accessories and options not provided on customized utility terrain vehicle;

(c) any expenses in operating the utility terrain vehicle (such as, gasoline);

(d) any expenses in claiming the utility terrain vehicleand preparing the utility terrain vehicle for initial use.

Winner is also solely responsible as well as for all taxes on the value of the prize. Sponsor will report winner’s receipt of prize to the Internal Revenue Service via IRS 1099 Tax Form and winner agrees to provide Sponsor or its designated representative with his/her Social Security Number or Tax Identification Number via IRS W-9 Tax Form upon request and to otherwise fully cooperate in Sponsor’s compliance with any and all tax-reporting requirements.

Prize will be awarded to winner at a street address in the United States. Allow 3 -5 weeks after verification of winner eligibility and compliance with these Official Rules for prize award. Prize will only be released to winner upon provision of valid government-issued photo identification (such as, driver’s license). 

Prize as awarded may differ from depictions of utility terrain vehicle in Sweepstakes advertising including but not limited to the Website. 

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PRIZE IS AWARDED “AS IS” AND SPONSOR MAKES NO WARRANTY OF ANY KIND (INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR THE INTENDED PURPOSE) AS TO THE PRIZE. THE ONLY WARRANTY ON THE PRIZE IS THE FACTORY WARRANTY PROVIDED BY THE MANUFACTURER OF THE UTILITY TERRAIN VEHICLE, WHICH IS SUBJECT TO ITS TERMS. 

Prize is not transferable by winner.

There is a limit of one (1) prize per person in any sweepstakes or contest offered by Sponsor within a six (6) month period.

 

6. ODDS:  Odds of winning the prize depend on the total number of eligible entries received.

 

7. ELIGIBILITY: 

 

The following persons are not eligible to enter or win the prize in the Sweepstakes: 

(a) Employees, officers and directors of Sponsor, its parent company, subsidiaries and affiliated companies;

(b) Employees, officers and directors of any entities otherwise involved in the development, design, production or implementation of the Sweepstakes;

(c) The immediate families (defined as: parent, child, sibling, spouse), regardless of where they live, of such employees/officers/directors;and

(d) members of the same household (whether related or not) of such employees/officers/directors.  

 

8. ADDITIONAL CONDITIONS OF PARTICIPATION: 

 

Sponsor disclaims any and all liability for:

(a) programming, technological, electronic or other error, failure or malfunction of any kind which in any way interferes with or impedes the intended operation of the Sweepstakes (including but not limited to the provision or receipt of entries as well as the efficacy of Sponsor’s attempts to notify potential winner or award the prize to winner once he/she/they has been verified as being eligible and otherwise in compliance with these Official Rules);

(b) entries that are not properly provided or provided at all in conjunction with item purchase at Website for any reason, even if reasonably foreseeable by Sponsor (all of which are void);

(c) entries that are lost, late, delayed, stolen,inaccessible, corrupted, jumbled, misdirected, damaged, illegible, garbled, incomplete or otherwise defective (all of which are void); 

(d) postage due 3” x 5” card entries/mail; and

(e) any damage to an individual’s computer or mobile device or the data stored thereon in conjunction with participation in the Sweepstakes.

 

Should any advertising in support of the Sweepstakes (including the Website) deviate from these Official Rules in any way, these Official Rules shall prevail, govern and control in all respects. The failure of Sponsor to enforce any provision of these Official Rules shall NOT function as a waiver of such provision. If the Sweepstakes cannot be conducted as originally planned due to any cause beyond Sponsor’s control (e.g., computer virus, act of fraud, strike, riot, civil commotion, natural disaster, governmental action[whether or not upheld as being lawful]), Sponsor may cancel, suspend, or modify the Sweepstakes and, to the extent feasible, make the prize available from among all eligible entries received prior to and/or after such action being taken or otherwise in a manner which is determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Notice of such action by Sponsor will be posted on the Website.

 

TAMPERING OF ANY KIND WITH THE SWEEPSTAKES, INTERFERING WITH THE CONDUCT OF THE SWEEPSTAKES OR ATTEMPTING TO DEFRAUD SPONSOR WILL RESULT IN AUTOMATIC DISQUALIFICATION FROM THE SWEEPSTAKES, PRIZE FORFEITURE (IF APPLICABLE) AND POSSIBLE PROHIBITION FROM PARTICIPATION IN OTHER SWEEPSTAKES/CONTESTS OFFERED BY SPONSOR, WITH THE UNDERSTANDING THAT THE PRECEDING DOES NOT REPRESENT THE EXCLUSIVE REMEDIES AVAILABLE TO SPONSOR UNDER SUCH CIRCUMSTANCES.

 

9. RELEASES:

 

BY PARTICIPATING, YOU RELEASE,INDEMNIFY AND AGREE TO HOLD HARMLESS (I) BARNICLE CUSTOM MOTORSPORTS LLC, ITS PARENT COMPANY, SUBSIDIARIES, DIVISIONS AND AFFILIATED COMPANIES; AND (II) THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, REPRESENTATIVES, AGENTS,  SUCCESSORS AND ASSIGNS FROM ANY AND ALL LIABILITY ARISING FROM PARTICIPATING IN THE SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, RECEIPT OR USE/MISUSE OF PRIZE, IF AND AS APPLICABLE.

BY ACCEPTING PRIZE, EXCEPT WHERE PROHIBITED BY LAW, WINNER GRANTS TO BARNICLE CUSTOM MOTORSPORTS LLC THE RIGHT TO USE HIS/HER/THEIR NAME, PHOTO, IMAGE, LIKENESS, AND OTHER INDICIA OF PERSONA FOR PROMOTION, MARKETING AND TRADE PURPOSES, WITHOUT FURTHER COMPENSATION OR NOTICE OF ANY KIND.WITHOUT LIMITATION, THE PRECEDING INCLUDES WINNER’S PARTICIPATION IN MEDIA INTERVIEWS UPON THE REQUEST OF BARNICLE CUSTOM MOTORSPORTS LLC.  BARNICLE CUSTOM MOTORSPORTS LLC WILL NOT HAVE ANY LIABILITY SHOULD IT CHOOSE NOT TO MAKE USE OF SUCH RIGHTS FOR ANY REASON.

 

 

10. PRIVACY POLICY: The collection, use and sharing of information provided when entering the Sweepstakes is subject to Sponsor’s privacy policy, accessible at https://barniclecustommotorsports.com/policies/privacy-policy. It is strongly recommended that you review Sponsor’s privacy policy BEFORE entering the Sweepstakes. 

 

11. DISPUTES/CHOICE OF LAW: To the fullest extent permitted by law, you agree that

 

(a) Any dispute regarding the Sweepstakes or these Official Rules will be governed by the laws of Florida without regard to conflict of law/choice of law provisions of Florida or any other state;

(b) You are subject to the personal and exclusive jurisdiction of the U.S. District Court for the Southern District of Florida (situate in Fort Pierce, Florida) or Florida State Court situate in Sebring, Highlands County, Florida;

(c) You waive any right to change of venue, forum non conveniens or the like;

(d) Any action will be brought by you individually and not as part of a class or as a private attorney general;

(e) Your recovery in such action will be limited to your costs in participating in the Sweepstakesbut in no event more than $10, with consequential, compensatory, incidental, punitive or other damages, attorneys’ fees and any form of equitable relief (e.g., injunction) being expressly waived.

 

12. Winner’s List: For the name of the winner (first name, last initial; city/state of residence), send a self-addressed, stamped envelope to Barnicle Custom Motorsports LLC Sweepstakes Alpha- Winner  P.O. Box 129 1665 US Highway 98 Lorida, FL 33857-9800. Requests must be received by May 15, 2026.
